And so, with the release of the unanimous decision from the Court of Appeal on Monday, Toronto police Const. Di Luca convicted Michael Theriault of assault after finding the clash devolved into a “one-sided” beat down of Miller. The Court of Appeal’s decision not only upholds Theriault’s conviction and sentence but also is likely to have far-reaching implications for future cases involving anti-Black racism and police officers. The Court of Appeal also dismissed the Crown’s appeal of Di Luca’s verdict. The Court of Appeal did not weigh in the prosecutors’ arguments because the Crown had asked for a new trial only if Theriault’s assault conviction was overturned.
