The second issue is whether the government of the Tigray state acted within its constitutional mandates when declaring SoE. Restrictive measures of the federal government and their constitutional basisAs mentioned above, the federal government is taking increasingly restrictive measures since 13 March. After having declared SoE the federal government can lawfully restrict certain freedoms, including freedom of movements. The Tigray state thus acted within its constitutional mandate when declaring SoE to contain the spread of the COVID-19. If on the other hand the federal government orders a total lock down, the Tigray state should be required to follow suit.
