Amanah's bid to challenge appointment of Md Raus as CJ fixed for Feb 14 - Nation


KUALA LUMPUR: The High Court will decide on Feb 14 next year whether to hear a legal challenge against Tun Md Raus Sharif's (pic) appointment as Chief Justice. Abang Kerdee is seeking leave to get a declaration that Raus' appointment as an additional judge and as CJ, under Article 124 (4) of the Federal Constitution, are unconstitutional and thus invalid. He also sought leave to get a writ of quo waranto for Raus to explain the basis of him holding the post of additional judge or CJ. He aded that the writ of quo waranto was justiciable as it was directed at the appointee, Raus, not the appointer, the Agong. In his application, Abang Kerdee said a CJ should retire at the age of 66 years and six months, the automatic retirement age, without extension.
