District Attorney David Soares announced Tuesday he will ask the Albany City Court to drop the pending charge against Cuomo, which the Albany County Sheriff’s Office first filed in October. It was at the center of a dispute between Soares and Albany County Sheriff Craig Apple, whose office angered the prosecutor when it filed the complaint without his knowledge. Cuomo had been due in Albany City Court on Friday at 1:30 p.m. for an initial court appearance. "I feel very confident that the district attorney is going to prosecute this," Apple said in October. She sat for lengthy testimony with the lawyers hired by the Attorney General’s Office in May, and was also cooperating with both the sheriff and district attorney.
