It is hoping the Supreme Court will come to the rescue. The decision by a three-judge panel ordering new districts “is not just wrong, but egregiously so,” Texas told the Supreme Court. The Supreme Court turned down North Carolina’s request to review the 4th Circuit ruling. A decision in the affirmative would surely be appealed to the Court of Appeals for the 5th Circuit and, depending on the outcome, to the Supreme Court. And, of course, the Supreme Court has changed, too.
