Bertolini said Tuesday during the company’s fourth-quarter earnings call that the merger agreement with Humana doesn’t expire until Feb. 15. Therefore, Aetna executives plan to “take all of that time” to up to Feb. 15 to decide whether or not to appeal , Bertolini said. In Aetna’s fourth quarter, growth in its Medicare business helped the company overcome losses in the commercial individual business under the Affordable Care Act. Aetna's Medicare Advantage business grew 9% to nearly 1.4 million members in the fourth quarter. But Bertolini said he sees growth ahead in the Medicare business as well as Medicaid where the ACA expanded coverage to millions of Americans.
