Abortion Debate Plays Out in State Supreme CourtsUnited States Supreme Court, Washington, D.C. Source: Hisham F. Ibrahim/Getty ImagesAfter the U.S. Supreme Court overturned Roe v. Wade and Planned Parenthood v. Casey in the June 24, 2022 ruling in Dobbs v. Jackson Women’s Health Organization, each state has had the right to determine whether abortion is legal within its borders. On Jan. 5, 2023, the South Carolina Supreme Court overturned a South Carolina law that banned abortion at about six weeks into a pregnancy. Later that same day, the Idaho Supreme Court ruled that the Idaho state constitution does not include a right to abortion, leaving in place the state’s three abortion bans.
