Attorney General Mahbubey Alam said on Monday that the state will file an appeal within a month challenging the High Court order declaring the 16th amendment to the constitution illegal. “We’ve been trying to have the certified copy of the verdict passed by the HC, and we’ll file an appeal once we get it. On September 17, 2014, the parliament passed the ‘Constitution (16th Amendment) Bill, 2014’ without any opposition, empowering the parliament to impeach judges of the Supreme Court in the case of their incapacity or misconduct. On May 5, the High Court declared the 16th amendment illegal and contradictory to the national charter. The AG said two judges declared the 16th amendment to the constitution illegal while another passed an order terming it legal.
