“[W]e submit that this honorable commission has no basis in law and jurisprudence to favor, and issue moto proprio or otherwise a provisional authority to ABS-CBN,” its chairman, Estrellita Juliano-Tamano, said. Once the network seeks a provisional authorization, Juliano-Tamano said the NTC should observe procedural due process and notify affected parties, including Fictap, to air their side. The Fictap chairman stressed that a provisional authority given to the network would be “unconstitutional” because it violates procedural due process. The legislative franchise of ABS-CBN has been the main target of President Rodrigo Duterte’s ire. Last February, ABS-CBN President and Chief Executive Officer Carlo Katigbak apologized for not running a political ad of Duterte when he ran for president in 2016 and for failing to return the payment.
