नैनीताल स्थित उत्तराखंड हाई कोर्ट की फाइल फोटो।उत्तराखंड हाई कोर्ट ने 2011 में सड़क हादसे में जान गंवाने वाले भारतीय सेना के जवान के परिवार को दिए गए मुआवजे के आदेश को बरकरार रखते हुए उत्तर प्रदेश राज्य सड़क परिवहन निगम (UPSRTC) की अपील खारिज कर दी है। कोर्ट के इस फैसले से मृतक सैनिक के परिजनों क. जस्टिस पंकज पुरोहित की सिंगल बेंच ने पिथौरागढ़ मोटर एक्सीडेंट क्लेम ट्रिब्यूनल (MACT) के उस आदेश को सही ठहराया, जिसमें निगम को ब्याज सहित 28.91 लाख रुपए मुआवजे के रूप में देने का निर्देश दिया गया था। कोर्ट ने अपने निर्णय में स्पष्ट किया कि उपलब्ध साक्ष्यों और तथ्यों के आधार पर दुर्घटना के लिए बस ड्राइवर की लापरवाही जिम्मेदार थी।मामले के अनुसार, भारतीय सेना की 5वीं गार्ड्स रेजिमेंट में तैनात नायक गणेश सिंह 7 जुलाई 2011 को उत्तर प्रदेश के बरेली से उत्तराखंड के टनकपुर की ओर बस से यात्रा कर रहे थे। यात्रा के दौरान बस चालक ने वाहन पर से नियंत्रण खो दिया, जिससे बस सड़क किनारे खड़े ट्रक से टकरा गई।इलाज के दौरान तोड़ा दमइस भीषण टक्कर में गणेश सिंह गंभीर रूप से घायल हो गए थे। उन्हें तत्काल अस्पताल में भर्ती कराया गया, लेकिन इलाज के दौरान उनकी मौत हो गई। परिवहन निगम की ओर से कोर्ट में दलील दी गई थी कि हादसा एक साइकिल सवार को बचाने के प्रयास में हुआ और ट्रक सड़क पर गलत तरीके से खड़ा था।हालांकि, कोर्ट ने इस तर्क को स्वीकार नहीं किया। कोर्ट ने कहा कि निगम अपने दावे के समर्थन में कोई ठोस साक्ष्य प्रस्तुत करने में विफल रहा। कोर्ट ने विशेष रूप से इस तथ्य को महत्वपूर्ण माना कि बस चालक को गवाह के रूप में पेश नहीं किया गया।इसके अलावा, निगम की ओर से पेश किए गए तर्कों के समर्थन में पर्याप्त प्रमाण भी उपलब्ध नहीं कराए गए। ऐसे में कोर्ट ने ट्रिब्यूनल के निष्कर्ष को सही मानते हुए निगम की अपील खारिज कर दी।हाई कोर्ट के इस फैसले को सड़क दुर्घटना मामलों में जवाबदेही और पीड़ित परिवारों के अधिकारों के संदर्भ में अहम माना जा रहा है। अदालत ने यह भी दोहराया कि सार्वजनिक परिवहन संचालकों की जिम्मेदारी है कि वे यात्रियों की सुरक्षा सुनिश्चित करें और लापरवाही के मामलों में कानूनी दायित्व से बच नहीं सकते।

Police on Thursday arrested Shivam Mishra, son of local tobacco baron K K Mishra, in the high-profile Lamborghini crash on VIP Road that injured several people earlier this week, the police chief said. The arrest came a day after another man approached a local court claiming he was driving the luxury car at the time of the incident and sought to surrender. The court, however, rejected the plea after police reiterated that evidence showed Mishra was at the wheel. His clarification came after his apparent allegation – of Indian players using bats that produce unusually high power – sparked a debate. In the English translations of his earlier comments, Rajapaksa seemed to be questioning the bats used by Indian players in T20 cricket.
