Speaker of the National Assembly Moses Wetang’ula has said Parliament does not need to conduct public participation in the approval of Kithure Kindiki as the nominee to be the Deputy President. Mr Wetang’ula says Article 149 of the Constitution is express that Parliament should take a vote on the nominee and does not mention public participation. Mr Wetang’ula also ruled that there should be no debate on the matter as it is not contemplated in the constitution. On the number required to endorse the nominee, speaker Wetang’ula said only a majority of members present is required. The speaker was responding to a number of constitutional questions and procedures raised by MPs on the process of endorsing the new Deputy President nominee.

Senators last night voted to uphold five of the 11 charges preferred against Gachagua in the impeachment motion that was sponsored by Kibwezi West MP Mwengi Mutuse to impeach the deputy President. As such, President William Ruto, acting on the Gazette Notice from the Senate Friday nominated Kindiki to become the next Deputy President. That nomination has already been communicated to the National Assembly where MPs are currently considering to suitability of Kindiki to occupy the office. Their lawyer Danstan Omari has also asked the court to stop both President Ruto and the National Assembly from acting on the gazette notice and appointing a replacement for the deputy president. Those sued are the Speaker of the National Assembly, The Clerk of the National Assembly, the Speaker of the Senate and the Attorney General.

Kenya's President William Ruto has notified the National Assembly that he has nominated Interior Cabinet Secretary Kithure Kindiki as Deputy President to replace Rigathi Gachagua, who was removed from office by impeachment on Thursday, October 17. Prof Kindiki is the only Cabinet Secretary who has maintained the docket he was appointed to since September 2022 even after the Cabinet was dissolved and reconstituted this year. The Interior Cabinet Secretary is considered non-antagonistic and has acceptability across the political divide. His long-standing relationship with President Ruto will also be an advantage, having been his lawyer while he was facing charges at the International Criminal Court. He told the people of Tharaka Nithi, Prof Kindiki’s backyard, that the Interior CS had simply “missed the chance to be deputy president by a whisker.”His nomination to replace Mr Gachagua as deputy president therefore comes as no surprise to many in UDA and Kenya Kwanza Alliance circles.

The High Court has issued temporary orders stopping the replacement of Rigathi Gachagua as Deputy President until October 24, when the matter will be mentioned before a bench to be appointed by Chief Justice Martha Koome. The order was issued Friday by Justice Chacha Mwita, just moments after all 236 MPs in Parliament voted 'Yes' for DP nominee Prof Kindiki Kithure to replace Rigathi Gachagua. Justice Mwita further certified the petition by Mr Gachagua as raising substantial questions of law and public interest. Through lawyer Paul Muite, Mr Gachagua further sought court orders to stop President William Ruto from nominating his successor, pending the determination of his case. Mr Gachagua had also sought an order blocking the National Assembly from vetting and approving the nomination of the person submitted by the president to fill the vacancy in the office of the Deputy President.

In a last-minute effort to regain his office, Rigathi Gachagua has moved to court to stop President William Ruto from nominating a person to fill the vacancy of the office of Deputy President. Under a certificate of urgency, Rigathi through Senior Counsel Paul Muite maintains that the charges levelled against him before the national assembly and subsequently the Senate hold no water. At least 53 out of 66 senators on Thursday night voted to uphold the charge levelled against him by the national assembly last week. Gachagua who remains hospitalized now seeks an order to block the Senate from gazetting its resolution that upheld his impeachment charges. The respondents are listed as the speaker of the National Assembly, the Senate Assembly, the Speaker of the Senate, the Senate and the Attorney General.

Update: The Senate has concluded debate on Deputy President Rigathi Gachagua impeachment motion. Should the Senate uphold the impeachment, at least two-thirds of the 67-member House must vote in favour, which is 45 senators. The National Assembly voted to impeach DP Gachagua last Tuesday, on 11 charges which included corruption, undermining the government and stirring ethnic hatred. At the trial’s opening on Wednesday, Mr Gachagua stood in the Senate chamber as each charge was read aloud, to which he pleaded not guilty. Should the Senate uphold the impeachment, at least two-thirds of the 67-member House must vote in favour of the motion.
