[co-author: Lindsay Chapman - Articling Student]The Federal Court of Canada (Court) released its decision on November 16, 2023, in Responsible Plastics Use Coalition v Canada,1 which held that the Federal Government's labelling of all Plastic Manufactured Items (PMI) as toxic was both unreasonable and unconstitutional. In its application, the consortium challenged the Order on the grounds that it improperly extends beyond the federal government's criminal law power granted to it under subsection 91(27) of the Constitution Act, 1867. To be classified under this power, federal legislation must consist of a prohibition and penalty and have a valid criminal law purpose. As a result, the Order was not properly supported under the criminal law power and, and thus was beyond Parliament's jurisdiction. The Court disagreed with the Federal Government, finding that those opposing the Order "should not have to wait until regulations are enacted to challenge an unconstitutional order.
This review sought to identify the government’s policy responses toward migrants with regard to COVID-19 and lessons that could be learned for future pandemic preparedness, especially in terms of migrant health policy. This reversal from their March 2020 stance not to arrest undocumented migrants resulted in avoidable COVID-19 clusters in overcrowded immigration detention centres [61]. A similar situation unfolded in 2021 when Health Minister Khairy Jamaluddin announced that undocumented migrants could freely get vaccinated. This flip-flopping contributed to fear of arrest and vaccine hesitancy among undocumented migrants [62]. Lessons learnedBased on the identified key issues related to policies concerning migrant workers during the COVID-19 pandemic in Malaysia, two important lessons emerge:1.

Anti-Racism • November 27, 2023 • Judy HaivenIt may seem crude to compare the ravages of Islamophobia with the problem of antisemitism in Canada. I’m looking at the antisemitic incidents since October 7, 2023, which have spiked. In its 2021 Annual Audit of Antisemitic Incidents, B‘nai Brith claims the cumulative total of violent antisemitic incidents for the entire five-year period from January 1, 2016 through December 31, 2020 was 61. And yet, improbably, according to B’nai Brith Canada, Canada leads the US in antisemitic incidents by a staggering factor. He noted that there were 15 antisemitic incidents reported between October 7 and October 25.

As a Malaysian farm that practices vertical farming in greenhouses, Cultiveat Group Sdn Bhd offers a smart and sustainable choice to get fresh quality vegetables. Cultiveat was the brainchild of brothers John-Hans Oei and John-Ian Oei, who originally owned a business that serviced restaurants with their organic waste converter. The brothers had segued into traditional farming to utilize the resulting byproduct: organic compost. In searching for a solution, they later collaborated with developers from a plant cartridge technology, and after two years of research and development, Cultiveat was born. As a sustainable farm, its produce is grown in biodegradable cartridges that sit in reusable trays and incorporate eco-friendly features and practices.
The ban only lasts until April 2025, although it could be extended, and does not apply to the company’s local subsidiary, Teva Canada. The last federal contract with Teva Pharmaceuticals USA, a sole-source contract from the Department of National Defence for an adenovirus vaccine, appears to have ended in October, just days before the suspension began. Per the deferred prosecution agreement, Teva USA admitted its role in three price-fixing conspiracies involving different “essential medicines,” including a widely-used cholesterol medicine called pravastatin. He also wondered why Apotex was not also banned from federal government contracts after it admitted to its role in the price-fixing scheme years before Teva. Other than Teva USA, five other companies have been suspended or deemed ineligible for 10 years from bidding on Canadian government contracts.
