Judge Engoron will attempt to include examples of Trump's behaviour in which all elements of fraud are present, despite the victims' lack of evidence of reasonable reliance on Trump's financial statements. Engoron has previously stated that he does not want to give Trump any grounds for a successful appeal. In the Letitia James, the New York Attorney General, case, Engoron issued a partial summary judgement in September, concluding that Trump and top Trump Organisation executives had committed fraud. To get out of being punished, Trump's appeal will have to question the usual parts of fraud.
